Texas residents Alyce R. Payne, William French, Karen Michaels, and Lorna Harris filed the lengthy 23-page complaint in an Eastern Texas court yesterday on their own behalf as well as all customers who are not satisfied with their iPhone 3G purchase, claiming that Apple has committed breaches of contract and warranty, violating Texas business and commerce codes, and other infractions.

The suit is the second to be filed this week (among many others over the past several months) claiming the iPhone 3G performs poorly when connected via 3G because it “demand(s) too much power from the 3G bandwidths.”

Check out this code on the latest Apple iPhone Firmware. It is pointing to a handset that has not even been made yet? The “iPhone 2,1″? If you go back and look at past firmware  codes you will find the codes similar. The handset for the original iPhone was referred to as “iPhone1,1″. The iPhone 3g is the “iPhone 1,2″. So we can only imagine what a “iPhone 2,1″ could mean.

Apple has pulled a software update that was intended to fix graphics related issues with its latest notebooks just two days after pushing the patch to users via its Software Update mechanism.

It’s unclear what prompted the removal of the patch, released Monday as NVIDIA Graphics Update 2009 and pulled from the company’s website and automatic software update system on Wednesday.

The Cupertino-based Mac maker said the update was supposed to improve cursor movement when using the Apple Mini DisplayPort to Dual-Link DVI adapter with the Mini DisplayPort-enabled MacBook Air, MacBook and MacBook Pro introduced this past October.

AT&T may provide Macbooks with 3g?

AT&T is hoping to make 3G-enabled notebooks a staple of its cellular business, and in a recent interview hints that it may be chatting with Apple to extend its reach into MacBooks or other non-iPhone devices.

Sitting down with Fortune, AT&T’s Emerging Devices group president Glenn Lurie says he would like his company’s deals with Apple to extend beyond the iPhone, though he takes care to avoid implying any immediate collaboration on other hardware and portrays Apple as one of many device builders AT&T speaks with regarding future plans.

“We’re having conversations with lots of folks,” he says. “[But] I would very much like to do more business with Apple, and hope that we do.”

Apple censors the word boobs from the infamous Wobbles app description. The app will now be described as “You can make two (censored) and (censored) jiggle and bounce like real (censored) when you shake your phone”.  Now the interesting hypocrisy of this is that if you do a search of the word boobs on iTunes you will find 161 other things on iTunes with boobs in the title.  When an apple rep was confronted with the hypocrisy of music to apps, the rep said “I cannot comment on the policy of Apples app store”.

Sounds like apps are held to a hire scrutony than any other feature on the Appstore. Censorship from apple rears its ugly head. Come on Steve, this isnt the Disney board of directors.

uSirius Starplayr app comes to iPhone?

The long-anticipated marriage of Apple’siPhone and Sirius XM Radio is coming, according to Orbitcast.

Several unnamed sources are telling the satellite radio news site that the uSirius Starplayr program is being submitted to Apple over the weekend. The third-party application will then be just a head nod away from its official release through Apple’s App Store.

Is it too little, too late?

Online streaming has been a free perk to paying Sirius XM subscribers, but that is likely to change. Several reports indicate that the company plans to begin charging an additional $2.99 a month for the service — as it upgrades the audio quality — in March.

Having a home in Apple’s storefront is huge, but will consumers pay up? There are already plenty of free programs out there, including Pandora, Slacker, Time Warner’s  AOL Music, and CBS’  Last.fm.

Naturally, there is plenty at stake here. If Sirius XM is able to deliver its programming digitally, it will mean fewer receivers to subsidize. Streaming costs aren’t cheap, but this can certainly be an incrementally profitable offering for Sirius if so many other companies are giving it away. Several years from now, maybe even costly satellites and signal repeaters won’t be necessary. The downside there, of course, is that a level playing field will make things more competitive for Sirius XM.

Either way, the real crime here is that Sirius XM didn’t come to market with its own App Store program first. The ability to reach every iPhone user and any iPod Touch owner with a steady Wi-Fi connection is ridiculous to ignore.

Even when big brands stumble in the App Store — like Chipotle Mexican Grill’s  short-lived mobile-ordering program — it’s important to see companies roll up their sleeves to reach growing audiences.

Kudos to Starplayr if it does hit the market next month. Shame on Sirius XM for not getting there first.

Yes its true, Apple is not being recognized for there humane ruling over its employees. Fortune fails to report them in there latest release of the best employers in the U.S. In its 2009 compilation, the top company is named as brokerage firm Edward Jones, which has managed to avoid any ties to the credit crisis and during 2008 hired 698 new financial advisors in the first 10 months. In the upcoming year, the firm is said to be building a headquarters expansion for 500 more people.

Jones displaces Apple ally Google, which had remained in the top position for two consecutive years. The company now resides in fourth place, as a result of slowed hiring, and fewer perks such as annual ski trips. Photoshop and InDesign maker Adobe has meanwhile jumped from 40th to 11th place, with commendations for its “humane treatment” of 600 workers moved out of the company. Another large gain is ascribed to Microsoft, which has risen from 86th place to 38. The company is said to keep “morale budgets” for fun excursions, though the appeal of the company may be dubious following 5,000 job cuts.

Apple has not held a position in the top 100 employers list since 2006, despite having reached 337th place in Fortune’s 2008 Global 500 rankings, and the number one position in 2008′s most-admired list.
